Question
Hello I am the father of a child and getting ready to start my military career. I recently got married to a woman other than my childs mother. I leave for initial entry training a few months from now for aircraft pneudraulics repairer. My sons mother has not been allowing me to visit with my son although i pay child support, though have never been to court on the issue of custody rights, and have in the past had a verbal understanding(foolishly) on joint custody. My question is how and when do i set a court hearing to obtain rights to see my child without interfering with my shipping date or ability to maintain a career? Also does having a wife help me with ability to have any kind of custody, as she has helped me for three years raise my child, when i am based ?

Answer
Eric,
I had to consult with the JAG lawyers on this on.  They agree that it's a civilian matter and you should get it taken care of as soon as possible so it doesn't interfere with your military obligations.

Yes, having a wife who has helped you raise him should help your case, but how has she helped much if you don't see him often?  You need to think about that before you go before a judge who may ask the same question.

Good luck,
Colonel H
