Question
Having been diviorced since this law took effect and my former wife has since remarried and is a drug user.  When and what are the causes that can eliminate the deduction that she gets.

Answer
Hi Thomas,

I'm afraid none of this would make any difference. For details on the USFSPA, see my article at: http://usmilitary.about.com/od/divorce/a/divretpaydiv.htm

It's not "alimony." The term "property" means it's just the same as a house or a car. For example, if the court ordered that your ex-spouse be given the car as "property," you wouldn't be able to ask for the car back, if she got remarried. If the divorce court ordered that your ex-spouse got half of the value of the house, you couldn't ask that it be returned to you if he/she got remarried. Under the USFSPA, retirement pay is allowed to be treated as "property," by the state divorce court, just like the house or the car.

Hope this helps!
