Question
I have a question. I received an RE-4 Discharge for weight control failure from the Navy in 1995 after 8 1/2 years of service. I have since lost the weight. Is it possible to re-enlist in the Illinois Army National Guard? Would I need some sort of waiver? If so, how do I go about getting one? Thanks in advance.

Answer
Hi Bill,

I wish I could give you a definate answer, but I can't. The active duty Army and the Army Reserves are managed by the FEDERAL GOVERNMENT, and -- if you were trying to enlist in either of these agencies, the answer to your question would be "no." The Army (and Reserves) do not waiver RE Codes of "4" issued by the Navy, unless there is clear and consise evidence that the RE Code was issued in error (See Army Regulation 601-210 at: http://usmilitary.about.com/od/armyreg/l/blar601210.htm), paragraph 3-19(2)(a), and table 3-2.

However, the Army National Guard "belongs" to the STATE, and not the Federal Government. In other words, the rules may be different from one state to another, depending on the current "needs" of that state. The only way you're going to be able to find out for sure is to speak with an Army National Guard recruiter for the state of Illinois.
