Question
My son has been in the USCG for 3 years BM3.  Unfortunately he managed to get into a little trouble with drinking before he turned 21.  He was punished and things were back to normal.  He turned 21 and once again managed to get into trouble.  He was charged with having possession of a firearm in a motor vehicle after consuming an intoxicating beverage.  It's a Class Misdemeanor in AK.  His punishment thus far has been 2 weeks at a chemical use school in CA, 45 days restricted duty, loss of rank.  The worst is the manditory "separation from service for a second offense.  Both he and his 2 immediate supervisors have filed objections to separation and he feels his Chief would also.  What are his chances of not being discharged?

Answer
Hi Kurt,

No way to say for sure, as separation will be up to his commanding officer (see my article at: http://usmilitary.about.com/od/justicelawlegislation/l/aadischarge1.htm).

However, in my experience, it doesn't look good. He has two alcohol-related incidences in a single enlistment period (it shows he didn't learn from the first time).

As the Coast Guard is primarily a law enforcement agency, they consider such very, very seriously. While I can't know for sure, because I don't know his record, nor the personality of his commanding officer, I wouldn't hold my breath for his continued service in the Coast Guard.

Hope this helps!
