Question
I hope you can help. My husband was placed on TDRL in November 2005 for asthma, rated at 30%. He completed an evaluation in October 2006. And, this week we received a decision by the PEB board that they were awarding him only 10% with severance. (He has already been given a VA rating of 30% for his asthma) Should we file for a formal appeal with him present at the hearing? Do you have any advice on formal appeals with TDRL?

Hi Rach,

It probably wouldn't hurt to appeal (afterall, all they can do is say "no" -- ie, disapprove the appeal).

I'm afraid I don't have any specific advice. You may wish to check with a local chapter of DAV (Disabled Amercian Veterans). Many Chapters have members are volunteer their time to help with disability appeals, and I've heard they're pretty good at it.
