Question
i have a simple question for you.  I'm in the Marines and just recently got pulled over by MP's on base for having a radar detector.  Now I have to see the Majestrate.  MY question is this, i'm pretty sure the majestrate wont take my base driving away from me and probably just give me a warning, but does my company 1st sgt  have the authority to strip my base pass off my car?

Answer
Hi Alex,

You need to make an appointment to see a JAG officer for advice.

Driving of military installations is a privilege, not a right, and -- in most cases -- commanding officers have the authority to remove such privileges.  First Sergeants are often delegated such authority to make such decisions in "the name of" the commander.

On some bases, however, the authority to remove on-base driving privileges is held by the installation commander.  This is why you need to see the JAG -- to get information about who holds such authority on your installation, and get advice about what any appeal procedures might be on your base.

Hope this helps!
