Question
Well sir hopefully you can give me some advice here. I'm prior service regular Army 96-2000.  I enlisted in the National Guard in AUG 03 and i'm still currently serving.  I'm currently in the process of enlisting back into the regular Army.  The only problem I'm having is I have a few non military related alchool incidents.  I had a DUI in oct 2001.   In JUL 02 i was charged with another DUI which was reduced to wreckless operation, I blew under the legal limit.  Then I had one last offense in JUL 04 Charged with DUI again but was reduced to controled substance or something to that effect I do not remember the full title of the offense.  Currently my packet is at USAREC level.  Typically is it waiverable having three alchool related offenses are circumstances actually taken into considration?    Not to give you a load question but I do have a second thing to ask.  If USAREC denies my enlistment. Is it possible Under title 10 orders with the national guard while deployed overseas to enlist in the regualar army through an active duty units retention NCO?

Hi Ron,

Who can say? A single DUI arrest (even if the charges are later reduced) requires a waiver. I've never seen three waived before, but that doesn't mean it can't happen. Each and every waiver request is evaluated individually. Nobody can say which "moral history" waivers will be approved and which ones won't.

If you are activated under Title 10 orders, the same is true. In order to reenlist into the active duty Army, a waiver would first have to be approved (although in that case, it wouldn't go through USAREC, it would go through the Army Human Resources Command (HRC).
