Question
Hello I'm SFC Poole and I have a few soldiers that would like to join the U.S. Armed Forces but they are currently on probation how does that work or can they join.

Answer
Hi Corey,

First of all, the fact that they committed a criminal offense will likely require a waiver. Because you use the term "soldier," I assume you're talking about the Army? (Each service has different standards).

For the Army, criminal offense waiver procedures can be seen in my article at: http://usmilitary.about.com/od/armyjoin/a/criminal.htm (This is for the Army, Army Reserves, and Army National Guard -- other branches may have different requirements).

"Probation" is considered (by the Army) to be a "civil restraint," because it limits a person's ability to do certain things and/or travel to certain areas without permission. The Army regulation requires at least a 30 day waiting period, following removal from probation before a waiver request can even be processed (for details, see page 4 of the above linked article).

Hope this helps!
