QUESTION: Back in 1995, I charged with theft of personal property. To make long story short, I was caught, tried, convicted, time served. The amount of time was 1 year (which case ended up being 4 months 13 days.) This was the only felony I have ever received. It has been 14 years since the conviction. Would the felony be expunged from this point? I had a background check done about 6 months ago, and the only thing(s) that showed was the felony and a couple of misdemeanors. All charges have been answered to, all fines was paid, all time was served.

Unless you get a pardon, and follow up with an expungement order, the conviction will be there forever.

As to your question, Yes, it certainly could be.

Any attorney in your state should know the process for expungements. It only involves a few minutes of paperwork and a judge signing off on it, and then the order being distributed to the different agencies that would have your criminal records, reports, tickets, and etc in reference to the conviction.
