Question Hi Jim. I had asked you a couple questions before regarding a sexual assualt that happened to me. I was told by the police on scene not to report the incident, so I never did. Now I am wondering if there is any reason that I should report it to the police and if I still have that option? It's been nearly 8 months since the incident. I did by some luck though locate the likely suspect. Im not sure if there is anything I can or want to do with that info, but do I need to file a police report in order to press charges should that option ever come up? And if I still can file a report, will I be able to obtain a copy of it?
Thanks again for your help,
Bailey
Answer Hi Bailey,
There is in most states a statue of limitations for felony crimes and for misdemeanor I believe 2 years. At least in Ohio that's the way it was. As far as the Police taking a report. If it was me, I would, but who knows if they will. I know they should. I would call them and explain to them what happened and why you were reluctant to file a report at that time. If they don't take one I would say you have 2 options.
1. See the prosecutor and tell him you want a report or to file charges.
2. Contact there rape councilor and I would bet they will light a fire under the Police Dept. to make a report.
I hope this helped somewhat. Let me know if I can help any further.
