Question
Hi Mr. Toomey, a friend is making $100.00 payments twice a month on a car from me, it is still in my name and I have the title. We have a writen agreement that if he stops payment that he will bring it back . The car is not running and and he says he doesn't have it to make a payment. I told him to bring it back to me and now he won't. He said it is my car and for me to come pick it up or he will have it towed away. What are my options on this matter?

   It sounds like a civil matter to me.  You have entered into a civil contract with this other person and you both are in a disagreement over the terms of the contract.  If you sold him the car with a legal trasnfer of title then you seem to have the upper hand here but you would have to sue him in civil court depending on the laws in your state.  However if you did he could come into court and claim that you broke the terms of the contract because the car won't run.  So yes...its a mess.

I am available to give sound and reasonable advice which can solve most problems. Please do not ask me to do homework questions or online interviews. Young people should not rely on the Internet for interviews. Local police officers are normally very agreeable to assist students with interviews and surveys.

Graduate of the University of Maryland.B.S. in Law Enforcement.Attended numerous schools and training courses involving investigations, interviewing, interrogations, crime detection, domestic violence, and others. Recognized in court as an expert witness.

Received numerous awards during my police career for expert investigations. Handled the most sensitive and confidential investigations. In 1999 I won an award for my work with high school students while working in my new career in a large suburban high school.
