Cellular Phones/Subpoena Alltel call record

Hi, Debi.  Expert is just what I need right now.
I'm afraid I'm not gonna like the answer, based on some of your other responses, but here goes.
Can I subpoena phone records from Alltel (or, I guess, Verizon now) from November 2006?  Just whether caller was USING the phone at a particlar time on November 26, 2006.

You may be able to get records back from November 2006 with a subpoena. If that person had service with Alltel at the time. The carriers are required to keep records for several years and with subpoena, they can get those. Three years isn't too long ago. Have you checked with them? They can tell you for certain whether or not they can get these records. I know for fact that you can't just request them because they only retain a couple of months that you can get  (if you are the account holder). For archived records, it will take a bit longer and does require subpoena if you are not the account holder. Most people ask about text message content and that's what's not available. Cell phone records are required to be kept. I hope this helps. Thanks. DebiN
