Question
Can my wife supoena my text messages from Verizon because she knows I have texted a friend and sent pictures? Will they provide the information if she goes through an attorny but there is no crime or divorce filed?

Answer
If the phone number is in your name and your wife is not authorized on your account, she has no legal way to get the records of your text messages. Furthermore, Verizon doesn't keep the detail of these transactions only the sent and received info, not the detail. I'm not sure how that could be detrimental to you since she couldn't prove what it was that you sent. Why would an attorney even want to help her with this type of thing if there is no crime or divorce? People think that they can just subpoena records and believe me, they can't. I wouldn't worry if I were you because though your wife may be threatening you saying she's going to do this, she can't. The records are purged a lot sooner than you may think and once the text is deleted, it's gone, believe me. I hope this helps. Thanks. DebiN
