I wouldn't sue T-Mobile, simply signify them through legal means that these voicemails are needed to incite them to retrieve the said voicemails. But from your explanation, I have a clearer picture now and I realize that as we say in French "my dog is dead", meaning the situation is hopeless and there's nothing to be done to get back these voicemails. T-Mobile should however inform clients, one way or the other, that voicemails are purged on a regular basis. That would avoid painful or catastrophic situations, like the ones where a mother saving the voicemails of her now deceased son only to find them gone one day. Not everybody is a technology expert.
