Question
Wood burning fireplace and the damper is stuck in the up position

Hello Paul, is there a handle with a cotter pin in it? if so try to remove it (do not drop it or twist it) that might loosen the damper enough to set it back in its track and re install the handle. I would have a local Certified Chimney Sweep (www.csia.org, there you can look up by zip code to find one near you) take a first hand look at what you have so it wont happen again.
