Expert: Jason Barnette, Esq. - 8/29/2009
QuestionQUESTION: my mother was dyeing in the hospital and when an emergency would arise I would have to go to the hospital. Due to this situation I was demoted from asst.manger on the day i was going to make funeral arrangements. I was promoted by to asst manager when i came back after bereavement (6 days later , then I was fired 6 days later.
What can I do about this.
I believe it was retaliation because I complained than I was discriminated against because I was never made manager , they continually brought in black people to be manager when I was qualified and told I was being trained for the position.
ANSWER: Debbie:
Insofar as you are female you may have a case if the people they brought in were male. Moreover, if you are over 40 and the people they brought in aren't, you may also have a case. You need to consult with an experienced employment law attorney.
If you reside in Tennessee, we at Barnette Law Offices would be happy to speak with you. We focus on employment discrimination throughout the state of Tennessee.

QUESTION: What about I am a 48 yr old white woman, and they keep bring in black younger woman to fill the position when I was supposedly being trained for the position?
AnswerDebbie:
It smells of age discrimination to me. Again, consult an attorney in your state or us if you live in Tennessee.
