Good day,
At what point in time do collection calls become harassment and stalking? I have one credit card company that calls between 8:00-8:10 a.m. daily and averages 6 calls a day, on the weekends it is more. I am in the process of completing my paperwork to file bankruptcy, but in the meantime, the calls are very frustrating.

Answer
Although there is no set number of times a creditor can call if it becomes annoying you may complain to the Federal Trade Commission. Many times they do not leave messages or if you don't answer the phone they will keep calling. The FDCPA says they may call between 8am and 9pm but they cannot call at times known to be inconvenient for you. This is very vague and is open to interpretation. If you are filing BK the calls will stop. If you want to stop the calls in the meantime you may send a cease and desist letter advising them you are filing BK. Send the letter certified mail return receipt requested. This should do the trick.
