Question
in may of 07 I had a baby with no insurance the medical bills are about $20,000 plus we do have credit card debt we figure its best to file for bankruptcy but one of our creditors washington mutual has served us papers can we still file for bankruptcy? the reason we haven't done so yet my husband and I thought that we could make an effort and pay these bills but with three kids we are just over whelmed by these bill and are going to be filling this friday January 11 2008

    Yes, you can certainly still seek Bankruptcy protection.  In fact, many people do this to discharge judgments which have already been entered.  Washington Mutual's Summons has no effect on your ability to file however, just ensure that the debt is included in the matrix and that their counsel is served with the filing from the clerk of the bankruptcy court.
