Question
I have one garnishment in affect by court order..was just informed by my employer of a second, i was never notified of this..just seen a second deduction from pay. Employer said it came from Capital one,the other came via sherrifs..this one i never went to court for..is capital one able to do this? Can i have two garnishments at one? i live in NJ

Answer
Normally you cannot have two garnishments at one time. I would question this with the employer and seek legal counsel to see if they can be stopped. You may be able to appeal both garnishments but you have to be able to show cause.

If you were never notified of a court proceeding against you you may also file a motion to overturn the judgement and fight the case, however if it is a valid debt they will just refile the suit.
