Question
I co signed for a motorcycle in 2005 in 2006 called customer service, seeing how i wasn't  the primary i had nothing but my social security # when i gave that to  the lady they told me the account was closed. 2007 the primary
went to buy another motor cycle after filing out a credit application  we/his own info  thought he was approved for his own card  learning out later as payments were late that the first account was still opened and my credit as a cosigner was very effected by this. with no information to the primary as a co signer they call me daily for payment. I feel lost don't know where to turn. using my credit as a backup i feel like i have no rights but i know i do

Answer
Tracy,

If the account was indeed closed as you were told, your responsibility as cosigner ended at that time.  Any future purchases would be the responsibility of the purchaser.  Ask the lender to send you a copy of any agreement you signed and if they can not, demand that they remove any reference to you and this account from the credit bureaus and to remove all of your information from the account itself.

If they resist, inform them that you are contacting the Federal Trade Commission, your state's Department of Consumer Affairs and the Attorney General, and, do so.  Be sure to dispute these items to all three of the major credit reporting agencies with a complete explanation, in writing.  I hope you have found this helpful and good luck with this situation.

Expertise

I am qualified to answer questions on the following subjects: FDCPA, FCRA and HIPAA as well as medical collections, general collections and collection agency related issues. I trained these subjects at a nationwide collection agency and customer service call center and audited around 150 representatives for compliance to the laws. I have been in the Collections Industry for over 30 years. I feel that everyone deserves to be treated fairly and with compassion and that is the way I trained collectors. Even though I worked for a Collection Agency, I get great satisfaction in helping those who have been mistreated or in need of help with these confusing issues.

Experience

I was the Compliance Administrator with a nationwide collection agency and customer service call center-I have trained hundreds of collectors on the above referenced topics. I have been in the medical collections industry for over twenty years and research these topics on a daily basis.
