Collections Law/Wage garnishmnet

Question
My husband had back surgery in 2004. I didn't sign anything or give any of my information at the hospital. He was working at the time. He hasn't worked much since then. I can't afford the bill of $13,000.00. The hospital was able to get judgment on me and are taking me to court to garnish my wages. I am the only one working and have 3 children to support. Since this is not my debt, can they actually do this? If so, is there any way that I can stop it? I am desperate. I am already in foreclosure on a second house that I had and couldn't afford to keep and  couldn't sell. The phone company cut my phone off and I have disconnect notices on my water and electricity bills. Is there any help for me? I don't know if it makes a difference, but I am in the state of Virginia.

Answer
It appears they may collect from you on medical debts for your spouse. You may try to defend yourself against this action but they already have a judgment and it may be too late unless you have a legal reason for filing a motion to overturn the judgment.

You might consider filing a Chapter 13 bankruptcy to stop any collection activity against you but you may not be able to afford the payments if your husband does not work.

If I had more information I may be able to come up with some options for you. If you would like to discuss your options give me a call at 937 372 8581. We are now a full service law firm and may be able to negotiate with your creditor to stop any collection activity.

Let me know.
