Question
I had taken out 3 pay day loans 3 years ago. From what i remember i had paid them all. They after a year i believe i started receiving calls that i still have a loan out and i better pay it. I requested information from which company it is and how much, they refused to fax me or mail me that information. Very heavy accent guy told me that i need to come up with 2,500 or i will be sued and he will call my employer and let them know what i had done. Now this was three years ago, i believe in 2005. Is thee any kind of resolution to this? First some people called me and said that they were going to put me in jail tomorrow and all that mean stuff. Please help, let me know what should i do.
I had posted fraud alert on my SS and Credit report , because they know my SS#. This' very scary.

Answer
Anna:

Contact the new debt collector/purchaser in writing and ask them to validate the debt.  In addition, tell them within the above communication that you cannot recieve phone calls at work or otherwise insofar as it inconvient.

As far as putting you in jail, threatening to do so is an FDCPA violation.  That is true unless your state law allows bad checks to fall under these auspices.  Most states consider these situations simple breach of contract.
