Question
Thank you in advance for your anticipated help. I enrolled Jan 2008 in an online Ph.D. program. I am in PA and the school is in Florida. All work was done by computer here in my home in PA. I left the program in Feb 2008. I wrote them a letter stating no further payments would be forthcoming. The outstanding bill is approximately less than $4000.00.
If they sue me for the remainder of the money (probably in florida), can I get the case moved to be heard here in Penna, as the damages took place here?

According to federal Fair Debt Collection Practices Act they must file suit in your location, usually in the county where you live.

If you sustained damages or believe they did not fulfil their obligation you may file suit against them or you can file a counter suit in the same court after they file against you, however if you file first you will probably have to file your action in their state.

It could be a while before they decide to file. They may send the account to a collection agency first. My question is were there student loans involved or did you have an installment agreement with the school? Please elaborate and I will try to  help you sort this out.
