Question
My husband has received a consent Judgment from a company named Unifund CCR Partners.  They are stating that he opened a credit card with Chase.  They have sent copies of a statement from Chase, but it is not in my husband legal name.  What happens if we don't sign the consent judgment.  I have answered every motion with the clerk of court stating that this in not my husbands debt.  What can they do if we don't sign?

Kelly:

It is essentially a confession of judgment under rule 68.  If you don't agree to it and they get a verdict for above the amount of the consent judgment, you'd be liable for the fees and costs.
