Question Hello - My husband and I lost our home in connecticut and are for the time being staying off and on with friends and in our vehicle - we have very little money and a failing small business which brings in just merely a couple hundred dollars a month to make our car payment and pay for car insurance and that is about all - we now reside in the state of washington. We found out through the mail (we have a temporary postal box) that the bank in connecticut froze what little money we had ($88) - it is the only money we had - we were saving for food and to make our car payment which is $200 a month. Now the bank is charging $5 a day in NSF fees. We were never served papers since we were kicked from our home months ago through foreclosure. Please help!
Answer I am sorry to hear about your troubles. One thing I can say for sure is things have a way of working out if you take even minor steps in the right direction. I have risen from the ashes myself and God has been good to me. A little prayer in earnest goes a long way.
As for the bank account being frozen, it would be necessary to check with the courts to see exactly who did what and how. If a creditor filed suit and obtained a judgment they will usually start attaching everything they can find in your name. You do have rights though. The biggest factor in resolving these things is timeliness. Once your account was seized you may have exempted the money from attachment. Certain moneys and assets are exempt from attachment. But you only have a short time period to file for an exemption before those moneys are gone. You usually have 10-15 days to file for an exemption hearing once the account is seized.
The bottom line is you need shelter and sustenance. In a situation such as yours it can sometimes be difficult to think about tomorrow but just take care of today and push to get assistance such as food and emergency housing. Contact the churches and the local Red Cross. Contact your state rep or congressman and tell them about your foreclosure and see if they may be able to direct you.
I wish I could offer more specific advice but in these situations there are few options but to hustle and generate cash flow. You cannot depend on others to pull you out of your situation but you can get some help. What has helped me in the past when I have been in situations like this is to become indignant at the situation. Excuse the expression but get pissed. Get aggressive and don't take no for an answer.
