Question
will be going to court in two weeks all, the lawyer for capitol one has are statements, no agreement no signature, the summons was served to my ten year daughter (14 years of of age is legal in the state of WI. the dept is $1200.00 dollars tried to settle but they refused. do they have a case just on the statements alone?

  The answer is that they probably do but, you would need to check Wisconsin case law to verify that.  Generally, statements will serve as proof of an alleged debt and it is your burden to rebut it.
