Collections Law - disability and debt

Expert: Michael Brotherton - 11/28/2008

Question
i was recently diagnosed with malignant cancer and have undergone major surgrey. i am now disabled and have filed for disability. i also have parkinsons, rls and chronic arthiritis. i am 6 months past due on  credit card debt of 80, 000
there is no way i am ever going to be able to pay this or any amount near it. my spouse barely makes enough to pay  house and insurance. i also have numerous medical bills not to mention  monthly doctor and prescription bills. what can i do. i am at a loss.

Answer
Your options depend on your assets and overall financial situation. If you are on disability that income is exempt from attachment so creditors cannot touch it. If you are a homeowner and the creditors decide to file suit they may be able to place a lien against your proeprty bt it is doubtful they will take your home.

This is one of those questions that require much more informaiton. I would be happy to discuss your situation directly with you. If you would like to discuss your options please call my office at 937 372 8581. You may be untouchable from a collection standpoint but no matter what fear not. The ball is in your court. They cannot do much without advance notice and you have options so relax and take care of yourself. You have more important things to do than worry about bills.

God bless.
