Question
Hi, my question is, last Friday i went to take money out of my checking account and was told my account was frozen because there was a court judgement against me.I was given the attorney's name and number. Upon calling the number i was told it was for a debt that i owed and that i never showed up to court for this matter.I told them i never received a summons and was told it was delivered to my parents house which i haven't lived in years. They said it was given to my mother whom is in her seventies an failed to give it to me.I guess my question is can i file to vacate judgement on this matter? I was also told by some people that the freeze on my account will not come of till the debt is satisfied. Can that be legally done? Thank you and have a good day.

Answer
Thomas:

Certainly you could file to vacate the judgment or have it set aside.  Then, the underlying judgment would be void and the levy would be lifted.
