AboutCreditwrench Expertise Debt Collections law, Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), federal law, how to properly answer court summons for collection cases, how to prepare federal cases against debt collectors, how to deal with debt collection phone calls.
Experience I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.
Education/Credentials Paralegal courses for the most part. I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
Question My husband recently received a call about a debt from 2000. I researched the company and found out they buy really old debt and try to collect on it for their profit.
We recently bought a house, no mention of any debt we would have to pay to close (I had to do it before so i know they would make us pay it before). Checked our credit on all three credit agencies the account is closed and paid.
So what I am wondering is why in the world they say we owe money because it isn't even on our credit? Do we have to pay such an old debt? The guy wouldn't even tell me his name, give me their address etc.
I am confused and even more confused by reading lots of blogs out their on this company.
I can well understand why you feel confused. First rule is never believe what somebody tells you either on or off the internet. Learn to do your own research. Somebody tells you about FDCPA ask them to show you the law they are talking about. If they won't do that then why would you believe them? First of all, there isn't any way you owe a debt that old. I don't know what state you live in but the statute of limitations should have run out by now. Check your state's statute of limitations to find out. http://consumers.creditwrench.com has a list of 2 different places you can check to find your state statute of limitations. Even those can be wrong sometimes so you can also look for your state statutes and see what they have to say about it. The two websites are only good for a quick check. Those are the only two that I am aware of that have anywhere near accurate information that is most likely up to date. Most web sites that have such lists don't keep them up to date and over time they become very unreliable.
I'd advise that you visit http://www.creditwrench.com/18questions.html and learn how to break them of calling you. If they sue you a response to the court will be needed to keep them from getting a judgment.
