Question
My bill was never sent to the correct address.  I just got a summons the other day.  The original creditor has a completely different address.  Once I found out, I paid the original creditor in full.  However, the collection agency demands interest and court costs.  Can I fight this extra cost?

Jay:

That would depend on whether they actually obtained a judgment.  If so and fees and costs were awarded then, yes, you would be liable for it.  It sounds as though no judgment has yet been rendered.  Respond to the complaint and plead accord and satisfaction as an affirmative defense insofar as the account has been paid.
