Question Recently I started receiving early-morning calls that appeared on my caller ID as simply “Pennsylvania” and a number. I have been on the national do-not-call registry since day one and rarely get telemarketing calls, so I assumed it was a political call and didn't answer. When the calls continued and no messages were left, I began to suspect a rogue telemarketer, so I called the number back with the hope of learning the name of the company so that I could report them to FTC. I was surprised when the person that answered called me by my name, and shocked to find that it was a bill collector. The person had a very heavy hispanic accent and was hard to understand, but eventually I learned that they were attempting to collect a debt for a local hospital here in Virginia. When I informed this person that I had never been treated at that hospital, she mentioned my husband's name. I informed her that he had only been treated there twice many years ago, and that it was covered by insurance. I went on to state that I was disputing the debt and requested verification in writing. This person then became extremely rude and kept raising her voice in an attempt to talk over top of me, so I ended up screaming back at her and told her not to call me again. That was on March 19, 2008.
Yesterday they called again. I wasn't at home and this time they left a message for me to return the call to Helen. When I did that, of course Helen wasn't there (and probably doesn't even exist), so "Mrs. Brown" volunteered to help me. Again, she knew exactly who I was without being told, but she at least tried to be civil. She asked for an account number and I told her that I didn't have one, but if she found the account, I would surely appreciate it if she would pass that information along to me. She then went through the "this is an attempt to collect a debt" routine and stated that the call "might" be recorded, and then proceeded to inform me that I owed this bill for services rendered at Prince William Hospital. I told her about my previous conversation with the unnamed person with the hispanic accent, and again stated that I was disputing the debt because it was covered by insurance and that this was the first I had heard about it in 12 or 13 years. She then quoted the two dates that my husband was seen at the hospital in 1996 and suggested that I pay the bill because interest is continuing to accrue.
I once again stated that it was covered by insurance and she asked me what the insurance company was. I replied that I had no idea, that my husband worked at Jiffy Lube at the time, and that I didn't remember if he was covered by his own policy there or if he was on my policy. Of course, she took that opportunity to ask me who his current employer was and I simply told her that it was a completely different company and that he now was insured through Kaiser. She then asked where I worked and I told her that I don't, that I am on disability. When she finally realized that she wasn't going to get any specific information from me, she again suggested that I pay the bill because interest was going to continue to accrue and the balance was already over $1600.
Again, I told her that the bill was covered by insurance and, even if it hadn't been, the SOL would have expired several years ago. She then stated that a judgement had been issued in 1998, and that a judgement can be pursued for up to 20 years. I told her that I know nothing about a judgement and again stated that I was disputing the debt. She verified my mailing address and stated that you only have 30 days to dispute a debt and I said yes, 30 days from the time that I receive something in writing. She stated that they had sent several written requests for payment, and I replied that I had never received anything from them, and suggested that she send it by certified mail.
Yet again, she suggested that I just pay the bill because of the interest, so I very firmly stated that if the hospital failed to collect from the insurance company and then failed to contact me about it, then it wasn't my problem, and if someone went behind my back and obtained a judgement without proof of proper service, that wasn't my problem either. I told her that I had absolutely no intention whatsoever of paying a debt that I am not responsible for, and again requested that she send verification in writing, at which point she hung up on me.
Now I'm thinking that, since we moved in 1997 (a year after my husband was treated at that hospital and a year before the judgement that she mentioned was supposedly issued), then it is possible that service was posted at our prior address and a judgement could have been issued, although it would have disappeared from my credit report by now so I can't verify it that way. But, even if a judgement was issued based on those circumstances, wouldn't it be invalid because I was not properly served? If so, how would I go about verifying it and then having it vacated? Also, if I managed to accomplish that, would that restart the SOL? I know that I do not owe the debt, but I have no records to prove it since it was so long ago. I have no intention of paying it just to shut them up, but I don't want to deal with their calls for the rest of my life either. Any suggestions? Thanks in advance for any help you can provide.

This is a very short and to the poing answer. This debt is out of statute and if they have a court judgment, do not worry, unless you receive OFFICIAL COURT PAPERWORK. Most likely, the judgment has not been renewed and this is bullshit.
Do not pay them a dime. Only deal with the court and ALWAYS RECORD their calls.
