Subject: Arbitration Award
Question Hi,
I recieved a letter via sheriff regarding an arbitration award being filed against me by MBNA / CACV.
Now the debt is past 4 years I am in Florida. My question is should I file a Motion to Vacate, or should i send a refusal of arbitration to the lawyer, and a motion to deny arbitration to the courts?
Answer I really don't have sufficient information to respond to your questions. Although the statute of limitations may be applicable for this debt it requires some research to be more specific whether it is sufficient to have the arbitration award vacated.
You will need to contact an attorney or otherwise research the matter further. You may not have sufficient grounds to have the case dismissed but without more information I cannot be certain.
