QUESTION: What is the law governing a collection agency disclosing debt information to a 3rd party without the permission of the debtor? I had one (Creditors Interchange) contact my Grandparents, and tell them if it wasn't taken care of immediately, they would be taking me to court. (So they paid it) It was $7800 that was leftover from a car I voluntarily turned in as I could no longer afford it. I have no problem paying the money, but I am rather upset that they told my Grandparents about it, and suckered them in to paying it.

ANSWER: Fdcpa says they can't do that and you can sue them for it and make them return the money to your grandparents but only if you are willing to take them to federal court to get the job done. You so might make them pay you money on top of that.

If you aren't willing to learn how to do that then you might as well get busy making payments to your grandparents.

QUESTION: So are you saying I should find a lawyer, or do this myself?

Answer
Finding a lawyer qualified to do this for you will be almost impossible.

There are a few good lawyers around the country but they are few and very far between.

If you live in Orange county California you might get Hyde & Swiegart or if you can find a NACA attorney in your area most of them are good but other than that you will probably have to do it yourself.
