Collections Law/Question on Process Serving

Question
I am working away from home at the moment, on a contract. I live in Michigan. I was called by my mother a few minutes ago, who is staying with me that someone had come to the door and asked for me, when she said I wasn't there, he left a card for me to contact him. She read me off the card and it says it is a process server, Boyne Process.

I have had cards go into collections in the past. I have not recieved any mail for at least a year or two that I never heard back on any validation that I requested on the debt on any debt collection, nor any calls , unless they are not leaving messages.

I have no idea what the process server is serving me.

I am not going to be home for a couple weeks. Do they have to serve me before they can set a court date,  Or before the 30 day clock for answer starts? He did not serve the papers to my mother.

What should I do? I really have no idea what it is for.

Answer
So do you live with your mother? In any event tell your mother not to accept any papers. Have her tell them you don't live there and not to bother her any more about this matter. Have her tell them she has no idea where you are because at the given moment they are asking her where you are she honestly don't know exactly where you are. She might know what town you are in or what state you are in but she sure don't know where you are at any given moment.

Then when you get back to town you need to go to the court house and check in the county clerk's office to see if there are any judgments filed against you. That will tell you what company is suing you and other important information. Get copies of all the paperwork in the file. That can give you valuable time to get your response ready to file when they finally do get you served.

Experience

I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.

Education/Credentials
Paralegal courses for the most part.
I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
