Question
Hi. My my exboyfriend and now fiance all got an apartment together. I moved out for about a month, and ended up homeless so my new fiance moved me back in so i wasn't home less..our room mate Shawn freaked and did $800 in damages to the property and personal damages.we ended up losing the apartment because we couldn't afford it with out a room mate. now the collection agency because they cant find Shawn say mike my fiance is 100% responsible because he has a better credit score, responded first, and they cant find Shawn. we cant afford to pay both halves and we know where he lives and they don't care..they say if we don't pay 2000 dollars in 2 weeks they are taking us to trial and that we will owe all he court fees

Answer
If they take you to court the debt will get attorney fees, court costs and interest added plus interest at about 10 percent per annum and anything else they can think of to tack on. The 2000 will easily turn into 4000 or more very quickly. They will go for garnishment and then go after wages, bank accounts and anything else they can find to garnish.

Also, they will probably lock you out and not even let you get your personal belongings. Best you get your stuff and get out of there really, really fast. In the middle of the night if need be or you will have nothing at all. You will come home and find a lock on the door and you are out in the cold.

Might happen and might not but personally, I would not take the chance.

Get your stuff and get out tonight if at all possible. Then call me and I will give you some ideas about how to stop them from getting a judgment against you.

Expertise

Experience

I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.

Education/Credentials
Paralegal courses for the most part.
I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
