Collections Law/Wrongful Judgement

Question
I just became aware that i have a judgement against because I worked for a contractor as a bookkeeper and they listed me as a partner which I am not and never was?  They also spelled my name wrong and never served me nor sent me any notices to appear in court.  What do I do to remove this judgement?

Answer
You may file a motion to set aside the judgment for the reasons given. They will probably have a hearing but you have a pretty good shot at winning your case. If they never served you and didn't give you an opportunity to defend yourself then this should be sufficient to get a hearing. You may want to speak to at least two attorneys to find out how to file the motion or contact the courts and ask them if you have to follow a particular format for filing the motion.
