Question
Several years ago 11 years to be exact my husband lost a job and financially we were devastated. We were unable to pay our credit card debt. We talked with an attorney who said we were judgement proof. So we let everything charge off and did not take out any new credit. At this time the only credit we have is our automoblie and student loan which will be paid off this year. I pulled our credit report last year and the only thing on the report at that time was the student loan and it was up to date. Now we are getting calls from an outfit wanting us to pay our speigal bill at the time of the job loss I notified the bank and asked that  the credit insurance that we had paid for every month be applied. They kept saying they would send the paper work and after 35 tries I gave up asking for the paper work. Now this guy is calling and we would like to know the next step. Thanks in advance Mary

Answer
The debt is almost surely out of stat. They can try to collect even though the debt is outside statute of limitations and they can even file a lawsuit against you to collect. If they do that you will need to file a statute of limitations defense. In the meantime I would tell him to go pound sand.

I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
