Question
I received civil papers that I responded to regarding a debt. I told the attorney about my employment situation. She agreed to reduce the amount of the debt by 75%, which was great. The problem was I had to borrow the money to pay the 25%. I requested that I be give three weeks to come up with the money to pay. She would only allow me two weeks. I only got a third of what I needed to pay the debt. I sent her a letter indicating that and request an additional week. She never responded to my request and now I've received a letter about going to district court. What is that about? Is this now a crimminal case? Should I obtain a money order and send it to her anyway? I have all of the documentation sent to her as well as her responses.

Answer
I would not send money unless you are still within the agreement period. Try calling her again and ask if she will allow you to pay it now without going to court. Get it in writing and ask her to dismiss the case once payment is made.

Also, this is a civil matter not a criminal one. You cannot got to jail for a debt such as this.

Now that suit has been filed it may be a bit more difficult to settle for the amount she agreed to but it never hurts to ask. Be persistent. She may relent.
