Expert: Creditwrench - 6/17/2008

I have recently been contacted by a "law firm out of NY".  Apparently, they have purchased an old credit card debt of $3000, that was discharged by the original creditor about  5-6 years ago (as far as I can make out).  They used a lot of "big words" that I know were meant to scare me, including "breach of contract."  I know what "breach of contract" means, but I never had a contract with THEM.  They purchased the loan from the original creditor -- who has already written it off as a loss AND received financial compensation for it, so it's not as though this "law firm" is representing the original creditor.  DO I have a "contract" with these people?  THEY are not my creditors, are they?  They chose to purchase this "bad debt" from someone else.  What legal rights to they have to pursue me -- references to appropriate statutes would be very helpful.  Thanks for your input.

No, you do not have a contract with these people and no, they are not your creditors. They do have a legal right to sue you for any reason whatever. They just have to prove that you are the person who owes the money.

Obviously you are not too happy with this situation. Why not learn how to fight back and win?

If you live within driving distance of Oklahoma City you can also come to our monthly meeting of the Oklahoma City Chapter of Jurisdictionary meetings.
