QUESTION: I just got an email notice that i have a negative charge on my credit report. So I investigate it, its a charge from Nov 1996. My question is how come this "unpaid bill" is just now showing up. And how can i prove that it's true. I don't recall not paying any bills prior to my move.
And why now after 12yrs and filing and completion of chapter 13, that they are contacting me and adding this to my credit report.
Any help on how to rectify this situation is helpful. Thank you.

ANSWER: Tenachi,

If you completed your chapter 7 and the bankruptcy was discharged the company has violated state and federal statues.  

Send the company the bankruptcy paperwork and request all information removed from your credit report.

It sounds like a debt purchaser bought the debt, and didn't scrub your account against a bankruptcy database.

QUESTION: Thank you for your time and information. Does it matter that i filed Chapter 13 and not Chapter 7? And that i did not include that old debt, because I did not know that it exist?

The courts never discharged the account since it wasn't included.  However the statue of limitations may have expired.  If they did your no longer responsible for the debt.
