QuestionMy sister got credit cards in my name without me knowing about it back in 2001 and up until 2006 i believe. I found this out when i got my credit report the other day. She did pay off the accounts that were in collections for a long time but they eventually got paid off by her. Is there any way i can clear my credit since i did not get these credit cards without having my sister go to jail if she admitted to doing this?
AnswerIm sure you don't want your sister going to jail over this. I'm sure that would cause a terrible rift between you and all the members of your family even if you didn't care anything about her and I'm quite sure you love your sister dearly no matter what she might have done.
As I am absolutely certain you already know, family is the most important thing in this life. Far more important than any sum of money.
So what is the way out for both of you? Simply don't go claiming that your sister did it to you. Keep quiet about that as far as the debt collectors and other strangers are concerned. You take the consequences for all of it and I'm willing to bet that there is a good chance your sister will pitch in and help if need be but if you do the right things that won't be necessary either.
Here is what you need to do. Simply dispute the debts and demand validation. Learn how to take them to court and win. You become the plaintiff because it is far better to be the plaintiff in a federal court than it is to be the defendant in any court.
Please understand and accept the fact that if you want to keep your sister from going to jail then you are going to end up in court anyway.
They can't force you to file charges against anybody, much less against your sister but they can and probably will sue you if you don't. That means you will end up in court and maybe several times before it is all said and done and you will lose every time unless you start working now and learning how to take care of yourself in court.
