Expert: Michael Brotherton Date: 7/1/2008 Subject: Medical Bill Collections
Question Hello Mike,
I heard that if I was seen for Medical reasons and have a bill that is outstanding, they are not allowed to give my information to a collection agency. Would you please tell me if this is true. And if they do, Do I have any recourse with the agency trying to collect or the company that provided this information.
Thank you in advance for your help
Ron M.
Answer I am afraid this is not accurate. If the creditor decides they cannot collect their money they may assign or sell the account to a third party for collection at any time. However, it does seem to be a touchy issue which requires more thought. With privacy laws what they are you would think that without your authorization your private information is being given to others without your consent.I don't know if anyone has ever tried to use this to fight the collection agencies. My guess is that it probably wouldn't fly. But it would be something to consult with an attorney about.
