Question LVNV Funding LLC is sueing me useing a laywer in my state of Maine. I sent the court and plaintiff for a bill of particulars the court gave the plaintiff till 7-08-2008 to give me the proof, till now I havnt recieved anything. Today 7-03-2008 I received from the plaintiff Interrogatories, production of documents, and request for admissions to answer. What do I do?I have 30days to answer. I did contact the credit beauru a while back and they erase LVNV off my credit report.
Answer What do you mean by you don't have 30 days to answer? Of course you do. But the question of much greater importance is whether or not the plaintiff answered your discovery requests? Did they? If not then at the end of the 30 days you need to file a motion to deem admitted and for summary judgment. This should be submitted to the court on the 31st day unless your court rules prescribe some other course of action.
