Collections Law - Collection Fees

Expert: Jason Barnette, Esq. - 10/25/2009

Question
I am a TN resident.  I can't find a TN statute that states what is the legal amount a collection agency or law firm can charge for collecting a debt for a third party.  I have a law firm that is charging a fee that is 111% of the original debt owed.

Answer
Stacy:

What you're thinking of is "usuary" limits.  It can only be used as an offset if the debt collector/law firm sues.

Since you're in Tennessee, feel free to contact our offices.  We can help.
