Question
Dear Mr. Shear:  I filed a Motion to Vacate Judgment in the NYC Civil Ct. (court date 10/13/09).  They had a judgment against me in the court and sent a "Marshal's Order of Execution" threatening to garnishee my wages and take non-exempt property.  I had never been served.  At court I found a copy of the service papers where the process server swore "upon good authority" that a co-inhabitant named Mr. Brian knew that I lived at the premises.  He gave the papers to a Mr. Brian and used this service to validate a hearing which I of course didn't attend and a judgment was ruled against me.  I haven't lived at said address since April 2006.  They served this man unknown to me in January 2009.  They allegedly mailed a copy to that address as well.  I sent a notice of the motion via certified mail to Mel Harris and the Marshal Ronald Moses.  This week Cohen %26 Slamowitz began calling me as well.  It is a Capital One debt from 2004 with an ending balance of $291. that has ballooned to 1,061.00 at the hands of these sharks.  I have dealt with a debilitating illness over the years and 2004-2006 were my worse years where bills piled up along with hospital charges.  I've begun to stabilize having begun working full time since 9/07.  I've paid off a state tax lien and a student loan.  It's slow but there's progress.  They are trying to destroy me.  I'm suing on the basis of incorrect service.  Is there anything else I can do?  Thank you so much!  I certainly wish I could fly you down and have you represent me.
