Question Hi Jack,
I really hope you can point me in the right direction.
Wife and I live in NJ. Wife had a Capital One card that went into collection and were contacted by Collection firm "AAA".
Was not disputed and they pushed through the courts leading to a lien on bank account for amt owed plus fees, interest, etc almost doubling the original Amt past due. Money was taken in 2006 and a letter was sent saying settled in full.
2 years later, another collection firm "BBB" contacts us saying they are collecting on the very same debt as what was paid in 2006. They back it up with copies of statements, SSN, etc. Basically all ducks in a row.
Looking back at the 2006 "AAA" firm, they didn't even have a SSN, or copies of statements, nothing to validate.
"BBB" contacts "AAA" to verify was paid in full and "AAA" says no, it was not the person you are collecting from !!!
What do we do ? Small claims court against "AAA" plus interest plus more ???
