About Creditwrench
Expertise Debt Collections law, Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), federal law, how to properly answer court summons for collection cases, how to prepare federal cases against debt collectors, how to deal with debt collection phone calls.
Experience I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.
Education/Credentials Paralegal courses for the most part. I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.

Question I live in Texas. I was contacted today by a collection agency for a department store credit card. i know I owe the money and I'm willing to pay.The thing is, on this account the last payment made was in July,1999. The lady told me they could put this back on my credit report and the debt was revived according to new federals laws. Is this so?
Answer If I were you I'd be begging them to do that so I could file a heavy lawsuit on them in federal court. I've got one like that myself. A debt collector called me yesterday and said I owed a debt from 2001 and wanted to know if I wanted to pay it. Of course I didn't want to pay it. I told them they needed to send me a letter telling me what it is all about. That was Monday so they have until Friday to get it into my hands or they racked up their 1st violation. They called again today and I demanded a letter again. Of course, when I get the letter I'll wait until about 25 days have passed and send them my demand for validation. I'll end up either goading them into filing a lawsuit against me or I'll file one against them. Either way they are sunk into a very expensive federal lawsuit against which they will have no defense whatever and they will end up owing me far more money than they can ever collect out of me. I'll be able to enforce the collection against them but they don't have a crying chance of collecting from me because the debt is way outside the statute of limitations in Oklahoma and the one you are talking about is probably out of stat in your state too. Such a federal lawsuit can be worth several thousands of dollars while they get nothing. Why pay a debt that the law says you no longer owe?
