Question What happens when the collector mails the initial communication and it is returned to them by the USPS marked as "Attempted Not Known"? I have seen where courts have held that the debt collector has to show evidence the initial communication was mailed, not rec'd. But what happens in a situation like this where the collector knows it wasn't rec'd?
Answer If they are able to get your correct address, they should send you another "first" notice. Dispute the debt in writing and ask for the letter to be sent to you for your review. This way, your rights will be protected. Should you pay the bill, asked that any entry to your credit file be removed since you did not have the opportunity to ask for verification of the debt.
