Question
Husband went to er in 3/09. insurance paid all except $360. they turned it over to collection. collection agency added my name because i'm his wife and checked my credit. the insurance wasn't in my name nor did he put that i would be responsible for this bill. we also do not live in a community property state. we contacted the company and told them that we would pay $50 a month each month. we started doing that. well we're being sued now. they have added extra $179 for suing us. When we go to court we will have paid them the origial medical debt and won't owe for that. will we have to pay $179 for them suing us. they sued us for $230

If they prevail, yes, you will have to pay the court costs and fees.  However, you should not be a party to the action nor should anyone have checked your credit.
