ANSWER: They can sue you and they can garnish wages, seize bank accounts, possibly seize vehicles that are free and clear of debt, boats, trailers or anything that has a title to it registered with the department of motor vehicles in your state. It is also conceivable that they could send a sheriff to your home to see what they can find to sell. So one of the first things I need to know in order to give you the best possible advice is what are your sources of income? Wages from work, SSI, pensions, what? Just tell me in general terms like that. I don't need to know specifics. But quite frankly I would not agree to pay them anything if I were you. First thing you knothey will be wanting you to sign a stipulated judgment or a cognovit note which will immediately be turned into a judgment and a garnishment of whatever assets they can find. Then you will be in real trouble. You need to learn how to fight their attempts to ruin you instead of trying to figure out how you can eat less or do without other essentials.

QUESTION: the source of income ismy husband onl..i do not have a job. i live is pa and i have nothing that is only in my name everything we own or is morgaged is is both our names while the credit card debt is solely in mine.

Answer
Sounds like you don't have a lot to worry about. Just keep all money that is not from pensions out of your bank account. Of course, you can always fight if you want to. I always recommend that people fight instead of just laying down and taking whatever comes their way.

Expertise

Debt Collections law, Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), federal law, how to properly answer court summons for collection cases, how to prepare federal cases against debt collectors, how to deal with debt collection phone calls.

Experience

I've been an active consumer advocate for more than 40 years and have helped hundreds of people win cases against debt collectors as well as helping them defeat demands for summary judgment lodged against them by banks, debt collectors and defeat mortgage foreclosures and keep their homes.

Education/Credentials
Paralegal courses for the most part.
I have been teaching people how to deal with judgments, mortgage foreclosures and other such problems both on and off the internet for many, many years. I am a Richard Cornforth information provider ever since 2000 and worked with many other organizations and causes since 1980. I was Oklahoma State Chairman for the nationwide drive to defeat the Constitutional Convention which was proposed by various factions within our federal government such as the Council of State Governments and the National Organization of State Governors who were working hard to organize a Constitutional Convention to be held in 1995 for the purpose of rewriting our American Constitution to be more acceptable to the United Nations. I worked with Senator Charles Duke of Colorado and Senator Don Rogers of California and many others across the nation to keep them from getting the number of delegate states required to lawfully hold a Con-Con and we were successful. I have worked with many other legislative issues in Oklahoma and have always been very successful.
